Termination & notice Either party may terminate this lease by giving the other not less than three (3) calendar months' written notice, expiring at the end of a complete rent period. The Lessor may re-enter and terminate where rent remains unpaid for more than thirty (30) days after falling due, or where the Lessee commits a material breach of this Agreement and fails to remedy it after reasonable written notice, subject to the applicable provisions of the Land Act, 2012. 10. Dispute resolution The parties shall first attempt to resolve any dispute arising from this Agreement amicably through good-faith negotiation. What should a land lease agreement in Kenya include?

A land lease agreement should identify the lessor and lessee, describe the parcel by its Title or L.R. number and location, state the term and the rent, define the permitted use (such as agricultural or commercial), and set out termination and dispute-resolution terms. Under the Land Registration Act, 2012, a lease exceeding two years should also be registered against the title.
