Tough economic times may lead to drastic measures and landlords may be forced to cushion themselves and their investment from suffering any loss that may arise from this. This may include or even necessitate an increase of the rental fees that are being charged on their property. The law stipulates that whenever this happens, there is a procedure that has to be followed to avoid exploitation of tenants by their landlords by unlawful increase in rental fees. A notice of rent increase is a formal document that is served by a landlord to a tenant to legally notify them of an unprecedented increase in rental price in the near future. The laws vary depending on your jurisdiction pertaining on how much is the legal allowable increment and how long should the notice serve before it is effective. The time should be chosen carefully and clearly communicated before which the proposed increment will go into effect. This could vary from 30 or 60 days. Landlords have been given the free will to determine the formula for the increment, for some areas it could be at their discretion but in some there is a legal framework that should guide them.

Documentation of this should be well done and records kept whether by writing or mail. Once a tenant has consented to the increment, their signatures should be taken and kept for reference to avoid conflict. The document name should contain the tenant name/address and their contact. It should clearly state the current amount and the new rental fees. The date of increment should also be clearly highlighted. The landlord should also cite the reasons for the increment this could be due to new taxation measures, new maintenance or new utilities/service. It is mandatory to leave a comment or a remark section within the document to allow the tenant to raise any queries regarding the increment. Tenants also need to know that they have a right to contest the increment in court and mediation could also be an option.

Any fines or penalties that may arise due to non-compliance of the increment should also be stated. Should eviction be necessary, it should also be cited. It is recommended that the communication channels between both parties should be kept open during this entire process as this could help in averting any disputes or legal challenges that may arise and also foster good relations between both parties.
